Titch...AAAGGGHHH!!!!!

I made the mistake of letting him loose in the garden whilst I was out then when I put him back in the pen, this was the result.

I'm concerned as when climbing back, he fell on his back twice - the first time I left him a little while before stepping in and righting him. My logic was that it may put him off doing it again. Wrong. I picked him up and put him in a different part of the pen then he went over and did exactly the same thing again...  

Again he fell on his back and I left him but righted him when he started to get distressed. My concern is that this may happen when I'm not watching

This is something that people who have never kept them rarely believe; they do like to climb.  Ours used to try getting up the wall to the pond (about two feet high) and could easily get out of her enclosure if she put her mind to it.  I don't think it's something you're going to be able to discourage, unless you can have smooth sides with no ledges.

2 feet high! If I did that, it would block all the sunlight...grrr..

I know nothing about torts, but if you wanted smooth sides without losing the light would perspex be an option..?

Perspex doesn't let in UV light so that's a no-no
